Learn how to create one and secure your affairs before death to ease the burden on your loved ones.<\/p>\n\n\n\n<p>Nobody wants to talk about death, but it is essential to ensure your wishes and affairs are taken care of properly. <\/p>\n\n\n\n<p>Today, I want to discuss your last Will, how to create one, and why you need one.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-death-can-affect-an-executor-of-the-will\">How Death Can Affect An Executor Of The Will<\/h2>\n\n\n\n<p>When a loved one dies, the grief of death is often overwhelming and difficult to bear.<\/p>\n\n\n\n<p>I know this feeling all too well, as my stepfather passed away in 2013 after a COPD diagnosis and several cancer recurrences.<\/p>\n\n\n\n<p>If you\u2019re a surviving spouse or a very close relative, you may have to oversee the funeral arrangements and burial or cremation rites.<\/p>\n\n\n\n<p>During this time of mourning, it isn\u2019t likely to be a forethought whether or not the deceased had a<strong> last will<\/strong>, significant assets, or debts.<\/p>\n\n\n\n<p>However, setting up an estate cannot be delayed for long.<\/p>\n\n\n\n<p>Whether the deceased lived alone or had a surviving spouse, someone must assume the excellent task of sorting through the person\u2019s financial life and personal belongings.<\/p>\n\n\n\n<p>This is to meet the law\u2019s 683px\" \/><\/figure>\n<\/div>\n\n\n<p>Upon the individual&#8217;s death, one of the first questions is whether the deceased had a valid last Will and testament.<\/p>\n\n\n\n<p>There are <strong>three common types of wills in Canada,<\/strong> which I will discuss below.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-formal-will\">Formal<strong> Will<\/strong><\/h2>\n\n\n\n<p>A formal Will is a typed document that outlines one\u2019s wishes to sign in at least two witnesses.<\/p>\n\n\n\n<p>Note that the witnesses cannot be beneficiaries or the spouses of beneficiaries.<\/p>\n\n\n\n<p>A lawyer usually drafts formal wills as they know the proper wording and ensure that all issues are addressed.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-notarial-will\">Notarial Will<\/h2>\n\n\n\n<p>Similar to a formal Will, a notarial Will is solely used in the province of Quebec.<\/p>\n\n\n\n<p>The document is prepared by a notary and signed before the notary in the presence of at least one witness.<\/p>\n\n\n\n<p>The witness may also be a beneficiary or the spouse of a beneficiary.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-holographic-will\">Holographic Will<\/h2>\n\n\n\n<p>A holographic Will is a handwritten document signed by the person with no witnesses required and must be probated by a court or a notary if done in Quebec.<\/p>\n\n\n\n<p>However, this option is potentially problematic because a holographic Will can be lost, damaged, or destroyed.<\/p>\n\n\n\n<p>They are often misinterpreted and can be more easily challenged in court.<\/p>\n\n\n\n<p>Check with your provincial government; some provinces do not recognize a holographic Will as a legal document.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-budget-options-for-creating-a-will\">Budget Options For Creating A Will<\/h2>\n\n\n\n<p>A cheaper option is a <strong>Do It Yourself Will Kit,<\/strong> which uses a software program to generate pre-printed forms.<\/p>\n\n\n\n<p>Reviewing the pre-written legal terminology with this option is up to you.<\/p>\n\n\n\n<p>According to the law, if the last Will is not worded correctly, some provisions can be invalid.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-my-experience-in-executing-a-will\"><span style=\"color: #000000;\">My Experience In Executing A Will<\/span><\/h2>\n\n\n\n<p>My stepfather had listed me in his last Will to serve as the executrix of his succession.<\/p>\n\n\n\n<p>Succession is the term used for an estate in Quebec.<\/p>\n\n\n\n<p>He had also named his brother an alternate executor if I predeceased him or chose not to accept the role.<\/p>\n\n\n\n<p>My role as the executor was time-consuming and complex.<\/p>\n\n\n\n<p>It took several months to complete everything that was required of me, mainly due to the processing times of the government.<\/p>\n\n\n\n<p>There were several issues to handle when liquidating my stepfather\u2019s estate properly.<\/p>\n\n\n\n<p>You can hire an estate planning firm to be the administrator for those who don&#8217;t have the time, desire, or inclination to handle the details.<\/p>\n\n\n\n<p>The administrator can help the executor\/executrix navigate all government requirements, especially for large and complex estates.<\/p>\n\n\n\n<p>I initially consulted with the family notary and accountant to clarify some points, but I felt confident enough to handle the responsibility mainly independently.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-responsibilities-as-executor-of-the-will-after-death\">Responsibilities As Executor of the Will After Death<\/h2>\n\n\n\n<p>The following summarizes the key responsibilities I fulfilled as executor for my stepfather\u2019s estate.<\/p>\n\n\n\n<p><strong>Related<\/strong>: <a href=\"https:\/\/canadianbudgetbinder.com\/2019\/03\/21\/ultimate-guide-plan-ahead-death\/\" target=\"_blank\" Death<\/strong><\/a><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>I asked the funeral home to conduct a notarial search to determine if my copy of the Will was the most recent. The funeral home also filed the Act of Death (death certificate) request with the provincial government. These administrative services, among others, were purchased as part of the funeral costs.<\/li>\n\n\n\n<li>The funeral home requested the Quebec government the $2500 maximum death benefit payable for expenses related to his death. I received the cheque about 4 weeks after it was ordered. Note that this amount must be declared income on the deceased\u2019s final tax return. Check with your province to determine if they run a similar death benefit initiative.<\/li>\n\n\n\n<li>Notified the provincial and federal governments of his death and ensured they received a copy of the Act of Death (death certificate) and a copy of the Will. It took both government agencies about 4 weeks to enter on record that I was the executrix of his estate.<\/li>\n\n\n\n<li>Requested the cancellation of his SIN, medicare card, passport, other hospital cards, and forms of ID.<\/li>\n\n\n\n<li>He visited each financial institution he had dealt with to close accounts and inactivate debit and credit cards.<\/li>\n\n\n\n<li>He opened an estate account and transferred the assets from his closed accounts. The assets were held until I was ready to distribute the proceeds.<\/li>\n\n\n\n<li>I called various companies to cancel any services he had contracted for.<\/li>\n\n\n\n<li>Completed a written inventory of his personal belongings, financial assets, and liabilities.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-income-tax-after-your-death\">Income Tax After Your Death <\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>I reviewed his 2012 and 2013 tax returns to report his death before my accountant submitted them. Please refer to the government\u2019s guidelines and timeframe for submitting a deceased final tax return.<\/li>\n\n\n\n<li>After receiving the tax assessments and paying any amounts owing, I applied for a clearance certificate from the Federal and Quebec governments. This step was necessary because this granted certificate proved that any amounts owing to the government had been paid. I also felt more comfortable distributing the will proceeds after obtaining the clearance certificates. Note: It can take 6 &#8211; 12 months to receive the clearance certificate.<\/li>\n\n\n\n<li>My last act in the role of executrix was to pay any amounts owing to creditors and distribute the net proceeds to the beneficiaries. I required a signed statement from each beneficiary that they received their share. I then closed the estate account.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-dying-i-ntestate-without-a-will\"><span style=\"color: #000000;\">Dying <\/span>I<span style=\"color: #000000;\">ntestate (Without A Will)<\/span><\/h2>\n\n\n\n<p>Someone who dies without a valid last will in Canada dies \u201cintestate.\u201d &nbsp;<\/p>\n\n\n\n<p>This means that the provincial government will be the one to decide how the deceased\u2019s assets will be divided.<\/p>\n\n\n\n<p>Every province has rules to define who can benefit from the estate and how much.<\/p>\n\n\n\n<p>Usually, the legal surviving spouse and biological\/adopted children become the beneficiaries.<\/p>\n\n\n\n<p>Note that some provinces do not recognize a common-law spouse, which may lead the common-law spouse to petition the court for financial support as a dependent. &nbsp;<\/p>\n\n\n\n<p>This decision can force the estate into litigation and lose money for the eventual inheritors.<\/p>\n\n\n\n<p>Because the government cannot possibly know the true wishes of a deceased person, you are strongly encouraged to make a legal Will to ensure that your intentions are honored.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-resolving-debts-after-death-in-a-last-will\"><span style=\"color: #000000;\">Resolving Debts After Death In A Last Will<\/span><\/h2>\n\n\n\n<p>Have you ever wondered what happens when a loved one dies and you learn after the fact that they had <a title=\"Tic Toc\u2026 That\u2019s the sound of your debt clock\" href=\"http:\/\/canadianbudgetbinder.com\/2013\/10\/28\/tic-toc-thats-the-sound-of-your-debt-clock\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>debts<\/strong><\/a>?<\/p>\n\n\n\n<p>Well, it happens more often than you\u2019d think.<\/p>\n\n\n\n<p>Besides the emotional loss you feel when learning that the person has financial secrets, you may worry creditors can pursue you for repayment.<\/p>\n\n\n\n<p>In short, nothing will happen to you directly as long as you are not contractually obligated towards their debt.<\/p>\n\n\n\n<p>In other words, once you have never signed your name to a debt, you cannot be held liable to pay someone else\u2019s debt &#8211;
